MANHATTAN TATTOOS LLC d/b/a Manhattan Tattoos NYC SIM RACING COMPETITION PARTICIPANT WAIVER, RELEASE OF LIABILITY, TERMS & CONDITIONS, AND MEDIA CONSENT Please read this document carefully before signing. By signing below, you agree to be bound by all terms and conditions contained herein. 1. PARTICIPANT ELIGIBILITY AND IDENTIFICATION Participants must be 18 years of age or older to compete in the Sim Racing Competition. Government-issued photo identification (valid driver’s license, passport, or state ID) is required at check-in. No exceptions. The winner must present valid government-issued photo ID to claim the tattoo prize. Participants must be 18 years or older to receive a tattoo under New York State law. Manhattan Tattoos LLC reserves the right to refuse entry to any individual who cannot provide valid identification or who does not meet the age requirement. 2. ASSUMPTION OF RISK AND RELEASE OF LIABILITY By signing this waiver, the Participant acknowledges and agrees to the following: Participation in the Sim Racing Competition is entirely voluntary. Sim racing involves the use of electronic equipment including a racing simulator rig with a force feedback steering wheel, display screens, pedals, and seating apparatus. The Participant understands that use of this equipment carries inherent risks including but not limited to: motion sickness, nausea, dizziness, eye strain, headaches, repetitive strain injury, and general physical discomfort. DIRECT DRIVE WHEEL WARNING: The simulator uses a direct drive force feedback steering wheel. Unlike consumer gaming wheels, a direct drive wheel is an industrial-grade motor that generates extreme rotational torque with no internal gear reduction. This means the wheel can spin with sudden, violent force that the Participant may not be able to resist or control. The Participant acknowledges and accepts the following specific risks: • The wheel can generate enough force to break fingers, fracture wrists, sprain or dislocate joints, and cause soft tissue injuries to hands, wrists, forearms, and shoulders. • The wheel may snap violently in either direction without warning during gameplay events such as collisions, curb strikes, loss of traction, or mechanical failures within the simulated vehicle. • Operating the steering wheel requires actively resisting and controlling the force feedback — this is a normal and expected part of sim racing. The Participant understands that doing so may result in injury to their hands, fingers, wrists, arms, or shoulders at any time during use. • It is solely the Participant’s responsibility to judge when to maintain grip and when to release the wheel. Manhattan Tattoos LLC and its staff will not instruct participants on grip technique and accept no liability for injuries resulting from the Participant’s decision to hold or release the wheel at any point during operation. • The Participant accepts full responsibility for any and all injury sustained while operating the steering wheel, regardless of grip position, technique, or whether the injury results from correct or incorrect use of the equipment. • The wheel remains active and capable of generating force at any time while the simulator is powered on, including before and after the race. MANDATORY SAFETY REQUIREMENTS: The following requirements are strictly enforced. Violation of any requirement will result in immediate removal from the simulator and forfeiture of the participant’s slot with no exception: • No loose clothing, sleeves that extend past the wrist, scarves, lanyards, ties, hoodie strings, or dangling accessories of any kind while operating the simulator. These items can become entangled in the wheel mechanism and cause serious injury. • No jewelry on hands, wrists, or forearms while operating the simulator. This includes rings, bracelets, watches, and fitness trackers. Jewelry caught by the wheel can cause degloving injuries, lacerations, and broken fingers. • Long hair MUST be securely tied back in a bun or ponytail before sitting in the rig. Loose hair can become wrapped around the wheel shaft. • Participants must follow all instructions from competition staff regarding safe operation of the simulator. • Competition staff will inspect participants before they begin and may require removal or securing of any item deemed a safety risk. Refusal to comply will result in forfeiture of the slot. Individuals with a history of epilepsy, seizure disorders, photosensitive conditions, heart conditions, or any medical condition that may be triggered or aggravated by flashing lights, rapid on-screen motion, or simulated vehicle movement should NOT participate. By signing this waiver, the Participant confirms they do not have any such condition, or that they have consulted with a medical professional and have been cleared to participate. The Participant assumes all risk of personal injury, illness, or discomfort arising from participation in the competition, including but not limited to use of the simulator equipment, being present at the venue, and any related activities. The Participant hereby releases, waives, discharges, and covenants not to sue Manhattan Tattoos LLC, also known as Manhattan Tattoos NYC, its owners, employees, agents, volunteers, and representatives (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant while participating in the competition or while on the premises of Manhattan Tattoos LLC. This release applies regardless of whether such loss, damage, or injury is caused by negligence of the Released Parties or otherwise. 3. EQUIPMENT USE AND RESPONSIBILITY The simulator rig and all associated equipment (“Equipment”) are the property of Manhattan Tattoos LLC. The Participant agrees to use the Equipment only for its intended purpose and only in the manner directed by competition staff. Any use of the Equipment outside its intended purpose, or in a manner deemed irresponsible, reckless, or abusive by competition staff, that results in damage to the Equipment will result in the Participant being held financially responsible for the full cost of repair or replacement. Irresponsible use includes but is not limited to: excessive force on the steering wheel, pedals, or rig frame; striking, kicking, or intentionally damaging any component; attempting to modify equipment settings without authorization; and any behavior that competition staff reasonably determines to be abusive to the Equipment. Incorrect, irresponsible, or abusive use of the Equipment will result in immediate disqualification and a permanent ban from all future Manhattan Tattoos LLC sim racing events. No food or beverages are permitted while operating the simulator. Participants must have clean, dry hands before touching any Equipment. 4. COMPETITION RULES AND FAIR PLAY All participants must compete fairly and in the spirit of good sportsmanship. Any participant caught cheating, exploiting a glitch (whether known or unknown), using unauthorized assists, or gaining an unfair advantage through any means will be immediately disqualified. The determination of what constitutes cheating or exploitation is at the sole discretion of competition staff and is final. Competition staff decisions regarding lap times, disqualifications, and advancement are final. No appeals or disputes will be entertained. Participants must follow all instructions from competition staff regarding simulator settings. Unauthorized changes to car settings, assists, or any other parameters will result in disqualification. Participants must check in at least 5 minutes prior to their scheduled slot time. There is no grace period for lateness. Failure to check in on time will result in forfeiture of the slot with no refund, rebooking, or exception. Manhattan Tattoos LLC reserves the right to modify competition rules, format, schedule, or structure at any time and for any reason. 5. MEDIA CONSENT AND PROMOTIONAL RELEASE THIS IS A CONDITION OF PARTICIPATION. By signing this waiver, the Participant grants the following rights: Manhattan Tattoos LLC, its employees, agents, and representatives have the right to photograph, video record, and audio record the Participant before, during, and after the competition. The Participant understands and agrees that their session will be recorded automatically. Cameras and recording equipment at the simulator station, along with on-screen/gameplay capture, run automatically throughout the event and will capture the Participant’s image, voice, likeness, and gameplay without the need for any further notice. The Participant consents to this automatic recording as a condition of participation. All photographs, video recordings, and audio recordings (collectively, “Media”) become the exclusive property of Manhattan Tattoos LLC. Manhattan Tattoos LLC may use, reproduce, edit, distribute, publish, and display any Media featuring the Participant for any purpose, including but not limited to: marketing, advertising, promotional materials, social media content, website content, press releases, and any other commercial or non-commercial use. This media consent is perpetual, irrevocable, and worldwide. The Participant waives any right to inspect, approve, or receive compensation for the creation or use of any Media. The Participant waives any right to royalties, compensation, or payment of any kind in connection with the use of Media featuring the Participant. The Participant releases the Released Parties from any claims arising from the use of their likeness, voice, or appearance in any Media. 6. FOOD AND BEVERAGE DISCLAIMER Manhattan Tattoos LLC may provide complimentary snacks, beverages, and refreshments during the competition (“Refreshments”). These Refreshments are provided “as-is” and at the Participant’s sole risk. It is the Participant’s sole responsibility to identify and avoid any foods or beverages to which they may have an allergy, intolerance, sensitivity, or adverse reaction. Manhattan Tattoos LLC makes no guarantees regarding the ingredients, preparation, or allergen content of any Refreshments. The Participant releases the Released Parties from any and all claims, liability, or damages arising from the consumption of Refreshments, including but not limited to allergic reactions, food-borne illness, or any other adverse reaction. Participants with known food allergies or dietary restrictions are encouraged to bring their own food and beverages. 7. PRIZE TERMS AND CONDITIONS The winner of the competition will receive one (1) full tattoo session of up to five (5) hours at Manhattan Tattoos LLC at no charge (“Prize”). The tattoo must be completed within the single five (5) hour session. The winner is not required to use the entire time, but the work may not exceed it. Time beyond five (5) hours, or any additional sessions, are not included in the Prize and would be billed at standard rates. The Prize is for a new, stand-alone tattoo only. It may NOT be applied to, or used as an addition to or continuation of, an existing tattoo, an ongoing or multi-session project, or any piece already booked or in progress with the artist. The Prize must be redeemed within 90 days of the competition date. Unredeemed prizes are forfeited with no cash alternative. The Prize is non-transferable. Only the verified winner may redeem the Prize. Government-issued photo ID matching the competition registration is required at the time of redemption. The tattoo is subject to artist availability and scheduling. Manhattan Tattoos LLC will make reasonable efforts to accommodate the winner’s preferences for artist, design, and scheduling, but availability is not guaranteed. The winner must be 18 years or older and present valid government-issued photo ID at the time of the tattoo appointment, as required by New York State law. Standard tattoo health and safety requirements apply. The winner must not be under the influence of alcohol or drugs at the time of the tattoo appointment. Manhattan Tattoos LLC reserves the right to decline any design that the artist or shop deems inappropriate, offensive, or outside their capabilities. No cash alternative, exchange, or substitution of the Prize is available. 8. DATA PRIVACY a) Manhattan Tattoos LLC collects personal information including the Participant’s name, phone number, email address, and government-issued ID details solely for the purpose of administering the competition, verifying eligibility, communicating results, and fulfilling prize obligations. b) Contact information may be used to notify the Participant of future competitions and events hosted by Manhattan Tattoos LLC. Participants may opt out of future communications at any time by contacting info@manhattantattoosllc.com. c) Manhattan Tattoos LLC will not sell, rent, or share Participant personal information with third parties, except as required by law. d) By signing this waiver, the Participant consents to the collection, use, and storage of their personal information as described above. 9. INDEMNIFICATION The Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising from or related to the Participant’s actions, omissions, or breach of any term of this agreement. 10. DISPUTE RESOLUTION a) Any dispute arising from or related to this agreement or the competition shall be resolved through binding arbitration in New York County, New York, in accordance with the rules of the American Arbitration Association. b) The Participant waives the right to participate in any class action lawsuit or class-wide arbitration related to this agreement or the competition. c) This agreement shall be governed by and construed in accordance with the laws of the State of New York. 11. GENERAL PROVISIONS a) This agreement constitutes the entire agreement between the Participant and Manhattan Tattoos LLC with respect to the subject matter hereof. b) If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. c) Manhattan Tattoos LLC reserves the right to cancel, modify, or postpone the competition at any time and for any reason. In the event of cancellation, Manhattan Tattoos LLC shall have no liability to the Participant. d) The failure of Manhattan Tattoos LLC to enforce any provision of this agreement shall not constitute a waiver of that provision. 12. RACER ACCOUNTS, SPORTSMANSHIP, AND REMOVAL a) To enter, the Participant creates a racer account with a public “racer name” (handle) of their choice. The racer name must be appropriate: it may not contain or reference profanity, vulgarity, hate speech, slurs, sexual content, or anything harassing, threatening, or offensive. Manhattan Tattoos LLC may, at its sole discretion, reject, flag, or require a change to any racer name, or remove any account using a name that violates this section. b) The Participant agrees to conduct themselves with good sportsmanship at all times: be kind and respectful to other racers, staff, and guests; do not distract, harass, heckle, or interfere with any racer during their session; and respect the simulator, equipment, premises, and staff. Cheating, abuse, intimidation, harassment, or disruptive behavior of any kind will not be tolerated. c) Manhattan Tattoos LLC reserves the right, in its sole and absolute discretion and for any reason or no reason, to warn, remove, disqualify, or permanently ban any participant from this and all future Manhattan Tattoos LLC sim racing events at any time, before, during, or after the competition. A removed or banned participant forfeits their slot and any standing or prize eligibility with no refund, compensation, or appeal. d) A permanent ban may include adding the participant’s name, email address, and racer name to a blacklist that prevents future sign-ups. The determination of any violation, and the consequence imposed, is final and at the sole discretion of Manhattan Tattoos LLC. e) This waiver, release, and set of terms is signed once and carries forward across sessions and future events. By signing, the Participant agrees that this agreement remains in effect for their participation in future Manhattan Tattoos LLC sim racing competitions and events without the need to re-sign, unless and until Manhattan Tattoos LLC publishes an updated version, in which case continued participation is conditioned on acceptance of the updated terms. PARTICIPANT ACKNOWLEDGMENT AND SIGNATURE By signing below, I acknowledge that: • I have read and understand the entirety of this document. • I am 18 years of age or older. • I am voluntarily participating in the Sim Racing Competition. • I agree to all terms, conditions, waivers, and releases contained herein. • I consent to being photographed, recorded, and featured in promotional materials, and I understand my session will be recorded automatically by cameras and on-screen capture at the event. • I agree to compete with good sportsmanship and to use an appropriate racer name, and I understand Manhattan Tattoos LLC may warn, remove, or permanently ban me at its sole discretion for any reason. • I understand this agreement carries forward and remains in effect for future Manhattan Tattoos LLC sim racing events unless an updated version is published. • I understand that this is a legally binding document.
